Terms and Conditions of Sale

Version effective from January 10, 2025

These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between the company PILLS KEEP, hereinafter referred to as « the Seller, » and any individual acting as a consumer, hereinafter referred to as « the Buyer, » in the context of the sale of mobile phone accessories. Any order placed implies acceptance without reservation of these T&Cs.

Article 2 – Products
The products sold are mobile phone accessories. The essential characteristics of each product, including its intended use, are clearly described on the Seller’s website and product packaging. The Buyer must use the product exclusively for its intended purpose as indicated on the Seller’s website and packaging. The Seller accepts no responsibility for improper or unauthorized use of the sold accessory.

Article 3 – Orders
Any order placed on the Seller’s website constitutes acceptance of the prices and descriptions of the available products. Once the order is validated, a confirmation email will be sent to the Buyer summarizing the order details.

Article 4 – Pricing and Payment
Product prices are displayed in euros, including all taxes (VAT included). Delivery charges are not included in the prices and will be billed additionally, with the total amount displayed before order validation. Payment is made online using the secure payment methods provided on the Seller’s website.

Article 5 – Delivery
Products are delivered to the address specified by the Buyer at the time of the order. The Seller undertakes to ship the products within the deadlines indicated at the time of the order. In the event of a delivery delay exceeding 30 days, the Buyer may cancel the order and will be refunded within 14 days.

The risk of loss or damage transfers to the Buyer upon receipt of the products.

Article 6 – Right of Withdrawal
In accordance with Article L. 221-18 of the Consumer Code, the Buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal without justification or penalty, except for return shipping costs.

To exercise this right, the Buyer must notify the Seller by email or letter, using the withdrawal form or a clear statement.

Return Conditions: The product must be returned in its original condition, unused, and in its complete original packaging (including accessories, manuals, etc.). Any product returned incomplete, damaged, or used will not be refunded or will be partially refunded depending on its condition. Return costs are borne by the Buyer.

Upon receipt and inspection of the product, the Seller will refund the Buyer within 14 days, subject to compliance with the return conditions.

Article 7 – Compliance and Warranty
Products are covered by the legal warranty of conformity (Articles L. 217-4 to L. 217-12 of the Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code). In the event of non-conformity or defect, the Buyer may choose between repair or replacement of the product, unless this choice results in a cost disproportionately high for the Seller.

Article 8 – Liability
The Seller cannot be held liable for damages of any kind resulting from improper use of the sold products, especially if such use is not as indicated on the Seller’s website or packaging. The Buyer must follow usage instructions and take necessary precautions.

The Seller is also not liable for damages caused by third parties or unauthorized modifications of the product.

Article 9 – Personal Data Protection
Personal data collected during the order process are necessary for order management and business relationships. In accordance with the French Data Protection Act and the General Data Protection Regulation (GDPR), the Buyer has the right to access, rectify, and delete their personal data, which they can exercise by contacting the Seller.

Article 10 – Intellectual Property
All elements of the Seller’s website (texts, images, logos, etc.) are protected by intellectual property rights. Any reproduction, in whole or in part, of the site’s elements without authorization is strictly prohibited and subject to legal action.

Article 11 – Disputes and Applicable Law
These T&Cs are subject to French law. In the event of a dispute, the Buyer may seek conventional mediation or any other alternative dispute resolution method.

For purchases made by a consumer located abroad, any dispute will be subject to the exclusive jurisdiction of the courts in the Seller’s headquarters’ jurisdiction, provided this clause does not deprive the consumer of the protection afforded by mandatory provisions of the law applicable in their country of residence, pursuant to Article 6 of Regulation (EC) No. 593/2008 (Rome I).

Article 12 – Modification of T&Cs
The Seller reserves the right to modify these T&Cs at any time. The T&Cs applicable to an order are those in effect on the order date.
